These Terms of Use (“Terms”, “Terms and Conditions”) govern your relationship with the products and services of Fixeets (the “Service”) operated by Fixeets (“we”, “us”, or “our”).

Please read these Terms carefully before using the Service.

Your access to and use of the Service are conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Identity

In compliance with the French Digital Economy Confidence Act (LCEN) of June 21, 2004, we inform you that FIXEETS SAS is a simplified joint-stock company (SAS). Its registered office is located at 24 Allée des Châtaigniers, 49240 Avrillé, France. It is registered at the Trade and Companies Registry (RCS) of ANGERS under number 940 523 202.

You can reach us through the following methods: any email address associated with the domain name fixeets.com.

All notifications and communications between users and Fixeets shall be deemed effective whenever conducted through the method described above.

Intellectual Property

The Service and its original content, features, and functionalities remain the exclusive property of Fixeets and its licensors. The Service is protected by copyright, trademarks, and other laws of France and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Fixeets.

Links to Other Websites

Our Service may contain links to third-party websites or services not owned or controlled by Fixeets.

Fixeets has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Fixeets shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance upon any such content, goods, or services available on or through any such websites or services.

We strongly recommend that you read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Third-party Services

The Service may depend upon, interact with, or allow access to third-party services (such as Google services). Fixeets does not guarantee the availability or functionality of these third-party services and is not responsible for any interruption, failure, or malfunction caused by them. Your use of third-party services is subject to their own terms and conditions.

Subscriptions

Some parts of the Service are billed on a subscription basis (“Subscriptions”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles may be monthly or annual, depending on the type of subscription you select when purchasing a Subscription.

Your Subscription will automatically renew at the end of each Billing Cycle unless canceled. You can cancel your Subscription renewal via your “Stripe” management page linked to your user account.

A valid payment method, including credit card or bank transfer, is required to process payment for your Subscription. You must provide Fixeets with accurate and complete billing information, including your full name, address, state, postal code, phone number (optional), and valid payment details.

In case automatic billing fails, Fixeets will issue an electronic invoice indicating that you must manually make payment within a specified deadline for the full amount corresponding to the billing period indicated on the invoice.

Refunds

Monthly billing cycles for Fixeets product license Subscriptions are not eligible for refunds. However, refund requests for annual billing cycles may be submitted within 14 days of payment. Beyond these 14 days, no refunds will be granted. For all refunds relating to Fixeets product license Subscriptions, a 5% fee will be withheld to cover administrative and payment processing fees.

Terms of Use of the Add-on

  • Modifications to Generated Sheets
    Spreadsheet sheets created by the add-on must be modified only via the provided console. Any manual modification or modification via other means may render the Service unusable, without possibility of support or recovery from our team.

  • Model Regeneration
    Model regeneration results in the complete deletion of sheets generated in the document. Users are solely responsible for backing up their data before regeneration. For recovery, it is recommended to use Google’s restoration tools. No data backup is performed by us.

  • Usage Limitation
    Use of the add-on is limited to a single document per Google account. If a new model instance is generated in another file, the previously created document will automatically be considered obsolete and will cease to function.

  • Support and Assistance

Termination

We may terminate or suspend your Subscription without prior notice for reasons such as unpaid fees or violation of these Terms. If we terminate your Subscription for our convenience, we will notify you in advance. In either case, we shall not be responsible for damages or consequences resulting from such suspension or termination.

Disclaimer of Warranties

Fixeets provides the Services on an “as is” and “as available” basis. Your use of the Services is at your own risk. Fixeets makes no warranty, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement. Fixeets does not guarantee that the Services will be uninterrupted, timely, secure, error-free, or that defects will be corrected. Fixeets is not responsible for issues arising from third-party services or failures.

Limitation of Liability

To the maximum extent permitted by law, Fixeets shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses arising from (a) your access to or use of or inability to access or use the Services; (b) conduct or content of third parties on the Services; (c) content obtained from the Services; and (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or other legal theory, whether Fixeets has been informed of the possibility of such damages or not, even if a remedy set forth herein is found to have failed of its essential purpose.

Force Majeure

Fixeets shall not be liable for failure to perform obligations under this Agreement if such failure results from causes beyond Fixeets’ reasonable control, including but not limited to force majeure events, war, terrorism, civil unrest, government actions, labor disputes, third-party service outages (including but not limited to Google services), internet or utility service failures, or any other force majeure events.

Prohibited Uses

You may not use Fixeets for illegal, fraudulent, immoral, or unethical purposes, including but not limited to:

  • Spamming or any form of unsolicited bulk communication.

  • Engaging in fraudulent activities or schemes.

  • Using it for unlawful or malicious purposes.

  • Creating, distributing, or sharing content promoting hate, discrimination, racism, harassment, or violence.

  • Violating any applicable laws, regulations, or third-party rights.

  • Creating or sending content infringing upon intellectual property rights.

  • Creating offensive, harmful, or inappropriate content.

  • Sharing confidential or sensitive information without proper authorization.

  • Creating emails or documents containing malware, viruses, or harmful code.

We encourage responsible and ethical use of Fixeets, notably:

  • Ensuring the accuracy and authenticity of documents and emails generated or sent.

  • Respecting the privacy and consent of recipients when sending emails.

  • Using it in compliance with applicable data protection and privacy laws.

Fixeets reserves the right to terminate a user’s Subscription in case of illegal, fraudulent, immoral, or unethical activities.

Applicable Law

These Terms shall be governed by and interpreted in accordance with the laws of France, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions shall remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede any prior agreements we might have regarding the Service.

Changements

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will notify you at least 30 days in advance. Continued access or use of our Service after revisions take effect constitutes your agreement to the revised terms. If you disagree, please stop using the Service.
